FDA proposes new standards for gluten-free food

WASHINGTON (Reuters) - Makers of foods claiming to be free of gluten-containing grains such as wheat and barley would face tighter standards under new rules proposed on Monday to help protect patients with a digestive disease that prevents them from absorbing the protein.

The Food and Drug Administration, which oversees nutrition information on food packages, said its new definition for gluten-free foods would allow people with the condition, known as celiac disease, to better follow strict dietary requirements.

Food manufacturers can make a variety of FDA-approved statements about certain products -- from claims about heart disease to low-fat foods -- as long as they meet agency guidelines.

A number of companies already advertise their foods as "gluten-free," according to the FDA, but they follow different, inconsistent standards.

"Currently there is neither a regulatory definition of the term 'gluten free,' nor is there agreement among manufacturers or consumers as to what this term means," the agency said in a proposal posted on its Web site.

Under the new rules, foods claiming to be "gluten-free" must not contain any type of wheat, rye or barley, including hybrids. They also cannot use any ingredient made from such grains without having the gluten removed first.

Foods that carry the claim, but fail to meet the definition "would be deemed misbranded," the FDA said. Those that are naturally free of gluten and carry the claim without saying all such foods are also gluten-free would be considered in violation.
The agency's proposal did not say what, if any, action the agency could take against violators. FDA spokesman Michael Herndon declined to comment ahead of the proposal's official publication on Tuesday.

About 1.5 million to 3 million Americans have celiac disease, but just 40,000 to 60,000 have been diagnosed by a physician, according to the FDA.

Most patients can manage the disease by following a life- long diet without gluten, but even small amounts of the protein can cause problems.

The condition can damage the small intestine, causing bloating, pain, vomiting and other digestive trouble, as well as numerous other symptoms such as irritability, mouth ulcers and skin rash.

It can also lead to more serious complications, including mineral and vitamin deficiencies, malnutrition, weight loss, and stunted growth.

The public has 90 days to comment on the proposal, posted online at http://www.fda.gov/OHRMS/DOCKETS/98fr/05n-0279-npr0001.pdf, before the agency makes its final ruling. FDA proposes new standards for gluten-free food
