Sometimes selling a $7 billion blood thinner sounds like more trouble than it’s worth.
Bristol-Myers Squibb and Sanofi-Aventis just finished cleaning up the mess from botched negotiations trying to keep generic Plavix off the market in the U.S. Today, word comes out of the blue that a copycat version of the drug from a Swiss company may hit the market in Germany any day now.
“We expect first sales already in the current quarter,” the chairman of Schweitzerhall Holding said in a statement that we presume was translated from the German.
The company says its generic doesn’t infringe on the European Plavix patents, which expire in 2013, according to Morgan Stanley analyst Andrew Baum.
Baum and other analysts speculate that Scweizerhall has come up with a formulation that is different enough to allow the company to claim that the generic is not identical to Plavix, but similar enough to say the generic can be substituted for the branded version. (Several research notes out this morning say the company is likely using a different chemical salt than the one used by Bristol and Sanofi; alternate salts are substitutable in Europe, but not in the U.S., Baum notes.)
Sanofi and Bristol won’t like that argument, of course, and are likely to go to court to keep the generic off the market. The companies and their shareholders must be hoping that the Plavix generic fight goes better in Europe than it did in the U.S. At least, that’s what shareholders who aren’t bailing out must be hoping — Sanofi’s shares are down more than 4% today in Paris, the WSJ reports. 我领了，24小时后其他人可以再领。 May 9, 2008, 8:37 am
