Boston Scientific Owes $431 Million to Whom?

On top of a weak stent market, increased competition, and a heavy debt burden, Boston Scientific now owes $431 million to a guy named Bruce Saffran.

Dr. Bruce Saffran, to be precise, just won a patent infringement suit against the company in U.S. District Court. A jury in Marshall, Texas, concluded that the company’s Taxus Express and Taxus Liberte stents infringe on Saffran’s patents.

Boston Scientific “believes the jury verdict is unsupported by both the evidence and the law,” the company said this morning. The statement added that the company will try to overturn the verdict in post-trial motions, and will appeal the decision if necessary.
According to this complaint filed in 2005, Saffran is an MD-PhD based in Princeton, New Jersey. He argued that Boston Scientific infringed this patent, which is described as an invention “designed to help restrain small structural or minor fracture fragments, and the macromolecules they produce in specified compartment.”
Saffran’s law firm, Dickstein Shapiro LLP, told the WSJ that he is an independent inventor, whose “contributions to the advancement of medical technology needed to be recognized and rewarded.” On top of a weak stent market, increased competition, and a heavy debt burden, Boston Scientific now owes $431 million to a guy named Bruce Saffran.
